Effective date: 15 September 2026
1.0 (replaces all prior privacy policies published on watch.sparktv.ai)
This Privacy Policy explains how Spark TV LLC ("Spark", "we", "us"), 113 N San Vicente Blvd, Beverly Hills, CA 90211, USA, collects, uses, shares and protects personal information when you use watch.sparktv.ai, sparktv.ai, our mobile, tablet, connected-TV and streaming-device apps, and related features (the "Service"). Spark is the controller (or "business" under California law) of the personal information described here.
Our Cookie Policy explains cookies and similar technologies and forms part of this Policy. Our Terms of Service govern your use of the Service.
A. Information you give us
B. Information collected automatically
C. Information from third parties
We do not collect precise geolocation, biometric data, government identifiers, or (except where you volunteer it in a submission or communication) health, religious-belief or other sensitive information. Viewing choices are not treated by us as revealing sensitive characteristics, but you should be aware that they may be interpreted that way.
We use personal information to:
Legal bases (EEA/UK/Switzerland users): performance of our contract with you (1, 2, parts of 3 and 4); our legitimate interests in operating, securing, improving and marketing the Service, balanced against your rights (3, 5–7); your consent, which you may withdraw at any time (marketing email, non-essential cookies, interest-based advertising); and legal obligation (8).
We do not sell personal information for money. We share it only as follows:
Service providers (processors) acting on our instructions, bound by contract to use data only to provide services to us:
| Function | Provider(s) |
|---|---|
| Streaming platform, accounts and CMS | Vodlix (platform hosting) |
| Video encoding and content delivery network | Bunny.net (Bunny Stream / Bunny CDN) |
| Payment processing (web) | Stripe; PayPal |
| In-app purchases | Apple; Google |
| Sign-in | Apple; Google |

| Website and app analytics | Google Analytics (Google LLC); Plausible Analytics (cookie-less, aggregated) |
| Media storage and production tooling | Backblaze (B2 cloud storage) |
| Error monitoring, customer support and other tooling | Providers engaged from time to time under equivalent contractual terms |
Content and distribution partners: aggregated or de-identified viewing statistics (not your identity) shared with programme licensors and producers for reporting. Where a partner offer or hidden plan you redeemed is run jointly with a partner, we may confirm to that partner that their code was redeemed.
Advertising partners: see Section 4.
Legal, safety and corporate: to comply with law, subpoenas or lawful requests; to enforce our Terms; to protect the rights, property or safety of Spark, our users or others; and to a successor or acquirer in a merger, financing, reorganisation or sale of assets (you will be notified of any change in controller).
With your direction: when you choose to share content or connect a third-party service.
Ad-supported plans (Spark Plus) display advertising. Our advertising partners may use cookies, device identifiers and IP address to deliver, cap, measure and — where permitted by your settings and law — personalise advertisements. Under California and certain other U.S. state laws, this kind of disclosure to advertising partners may be considered a "sale" or "sharing" of personal information for cross-context behavioural advertising. The categories involved are identifiers, device/internet activity, and approximate location.
You can opt out at any time:
We do not knowingly sell or share personal information of users under 16. We do not use sensitive personal information for purposes other than providing the Service.
We keep personal information for as long as your account is active and thereafter only as needed for the purposes above:
Everyone: access and update account details in My Account; unsubscribe from marketing via the link in any email; manage cookies per the Cookie Policy; close your account via My Account or support@sparktv.ai.
California residents (CCPA/CPRA) have the right to: know the categories and specific pieces of personal information we collect, the sources, purposes and third parties; delete personal information (subject to legal exceptions); correct inaccurate information; opt out of sale/sharing (Section 4); limit use of sensitive personal information (we do not use it beyond service provision); and not be discriminated against for exercising rights. We do not offer financial incentives in exchange for personal information. In the last 12 months we collected the categories listed in Section 1 (identifiers; customer records; commercial information; internet/device activity; approximate geolocation; inferences; audio/visual content where you submit it) from the sources listed there, for the purposes in Section 2, and disclosed them to the recipients in Section 3; identifiers and internet activity may have been "shared" for advertising as described in Section 4. You may designate an authorised agent to act for you; we will verify the agent's authority and your identity.
Other U.S. states (including Colorado, Connecticut, Virginia, Utah, Texas, Oregon, Montana and others with comprehensive privacy laws): you may have rights to access, correct, delete, obtain a portable copy, and opt out of targeted advertising, sale and certain profiling. You may appeal a refusal by replying to our decision email; we will respond within the period your state law requires.
EEA, UK and Swiss residents (GDPR/UK GDPR): you have the right to access, rectify, erase, restrict, port, and object to processing of your personal information, and to withdraw consent at any time without affecting prior processing. Where we rely on legitimate interests, you may object and we will stop unless we have compelling grounds. You may lodge a complaint with your local supervisory authority (for the UK, the Information Commissioner's Office).
Australian residents: you may access and correct your personal information and complain to us and, if unresolved, to the Office of the Australian Information Commissioner. We handle personal information in accordance with the Australian Privacy Principles to the extent they apply to us.
Other countries: you have whatever rights local law grants; we will honour them.
How to exercise rights: email privacy@sparktv.ai from your account email, or write to the postal address above, stating the right you wish to exercise. We will verify your identity (normally by confirming control of the account email and, where needed, recent account details) and respond within 45 days (California and most U.S. states, extendable once by 45 days with notice) or one month (GDPR/UK GDPR, extendable by two months for complex requests). There is no charge unless requests are manifestly unfounded or excessive. We will not discriminate against you for exercising any right.
We send marketing email only if you ticked the marketing box at signup or later opted in, or where local law otherwise permits marketing to existing customers with an opt-out. Transactional and service emails (billing, security, trial-ending and policy-change notices) are sent regardless of marketing preference because they are necessary to run your membership. To stop marketing email, use the unsubscribe link in any message or email privacy@sparktv.ai; changes take effect within 10 business days.
The Service is intended for adults and, under adult supervision, for household members aged 13 and over. We do not knowingly collect personal information from children under 13 (or under 16 in the EEA/UK without parental consent where required). If you believe a child has provided us personal information, contact privacy@sparktv.ai and we will delete it.
We use administrative, technical and physical safeguards appropriate to the risk, including TLS encryption in transit, hashed passwords, tokenised payment handling by PCI-DSS-compliant processors (we never store full card numbers), access controls and logging. No system is completely secure; you are responsible for keeping your credentials confidential. If a breach affecting your personal information occurs, we will notify you and regulators as required by law.
Spark is based in the United States and the Service is available worldwide. Your personal information is processed in the United States and in other countries where we or our service providers operate, which may not provide the same level of data protection as your home country. Where we transfer personal information from the EEA, UK or Switzerland, we rely on adequacy decisions where available and otherwise on the European Commission's Standard Contractual Clauses (and the UK Addendum/IDTA) with our providers, together with supplementary measures where appropriate. You may request a copy of the relevant safeguards at privacy@sparktv.ai.
We use automated systems to recommend content and detect fraud or abuse (for example, unusual simultaneous-stream patterns). These do not produce legal or similarly significant effects on you without human review; if we suspend an account for suspected abuse you may contest the decision at support@sparktv.ai.
The Service links to and embeds third-party content (for example app stores, social media, partner sites and embedded design or video widgets). Those parties' privacy practices govern information they collect; we encourage you to read their policies.
We may update this Policy. Material changes will be notified by email to your account address and/or a prominent notice on the Service at least 30 days before they take effect, unless a shorter period is required by law. The Effective date above shows the current version. Continued use after the effective date means you acknowledge the updated Policy; where a change requires your consent under applicable law, we will ask for it.
