Terms of Service

Effective date: 15 September 2026

1.0 (replaces all prior Terms of Service published on watch.sparktv.ai)

These Terms of Service ("Terms") are a binding agreement between you and Spark TV LLC, a California limited liability company with its principal office at 113 N San Vicente Blvd, Beverly Hills, CA 90211, USA ("Spark", "we", "us", "our"). They govern your access to and use of the Spark streaming service at watch.sparktv.ai, sparktv.ai, our mobile, tablet, connected-TV and streaming-device applications, and every feature, page, player, chat, community, casting or other surface we operate (together, the "Service").

PLEASE READ SECTION 15 (DISPUTE RESOLUTION). IT CONTAINS A BINDING INDIVIDUAL ARBITRATION AGREEMENT AND CLASS ACTION WAIVER THAT AFFECT YOUR LEGAL RIGHTS. YOU MAY OPT OUT WITHIN 30 DAYS AS DESCRIBED THERE.

1. Acceptance of these Terms

1.1 By creating an account, starting a free trial, purchasing a membership, or otherwise accessing or using the Service, you agree to these Terms and to our Privacy Policy and Cookie Policy, which are incorporated by reference. If you do not agree, do not use the Service.

1.2 If you use the Service on behalf of an organisation, you represent that you are authorised to bind it, and "you" includes that organisation.

2. Eligibility and Accounts

2.1 Age. You must be at least 18 years old (or the age of majority where you live, if higher) to create an account or purchase a membership. Persons aged 13 to 17 may use the Service only through, and under the supervision of, an account holder who is their parent or legal guardian and who accepts responsibility for their use. The Service is not directed to, and we do not knowingly collect personal information from, children under 13.

2.2 Content maturity. Our catalogue includes programming on spirituality, consciousness, the paranormal, health and personal-development topics, some of which contains mature themes. Account holders are responsible for deciding what is appropriate for members of their household.

2.3 Account security. You are responsible for keeping your login credentials confidential and for all activity under your account. Notify us promptly at support@sparktv.ai of any unauthorised use. We are not liable for loss arising from unauthorised use of your account that occurs before you notify us.

2.4 Accurate information. You agree to provide accurate, current information (including a working email address and valid payment method) and to keep it updated.

2.5 Sign-in with Apple / Google. If you register or sign in using a third-party identity provider, that provider's terms also apply to your use of their sign-in service.

3. Memberships, Free Trials, Billing and Cancellation

3.1 Plans. We offer paid membership plans (currently "Spark Plus" and "Spark Ultimate") on monthly or annual terms. Current prices, features (for example ad-supported vs. ad-free viewing, number of simultaneous streams and maximum video resolution) and trial terms are shown on the plan selection page before you subscribe. Features and prices may differ by plan, region, platform and app store.

3.2 Free trials. Some plans include a free trial. Unless you cancel before the trial ends, your membership will automatically convert to a paid membership and the payment method you provided will be charged the plan price disclosed at signup. The trial length, the price you will be charged, the date of first charge and how to cancel are stated on the signup page and in your confirmation email. Trials are limited to one per person and per payment method; we may withhold a trial from anyone who has previously held a Spark account.

3.3 Automatic renewal. Your membership renews automatically at the end of each billing period (monthly or annual, as selected) at the then-current price for your plan until you cancel. By subscribing you authorise us (or the applicable app store) to charge your payment method on each renewal date without further notice, except where notice is required by law.

3.4 How to cancel. You may cancel at any time:

  • Web memberships (paid by card or PayPal through our site): go to My Account → Subscription on watch.sparktv.ai and click Cancel, or email support@sparktv.ai from your account email. Cancellation is effective at the end of the current paid period. Online cancellation is available at all times to anyone who subscribed online; you will not be required to call, chat or take any additional step.
  • App-store memberships (Apple App Store / Google Play): cancel through your Apple ID or Google Play subscription settings. We cannot cancel or refund app-store memberships on your behalf.

3.5 Effect of cancellation. After you cancel you keep access until the end of the period you have already paid for; you will not be charged again. Cancelling a free trial ends access at the end of the trial period. We do not provide refunds or credits for partial billing periods, unused time or unwatched content, except where required by applicable law or stated in Section 3.7.

3.6 Failed payments. If a renewal payment fails we may retry it for a limited period and may suspend or end your membership if it is not paid. You remain responsible for uncollected amounts.

3.7 Refunds. Payments are non-refundable except (a) where we, in our discretion, choose to issue a refund or credit; (b) where a refund is required by mandatory law in your country of residence; or (c) for app-store purchases, according to the refund policy of the applicable app store, which controls. If you are a consumer in the European Union, United Kingdom or another jurisdiction with a statutory cooling-off right, you expressly request that the Service begin immediately upon subscription and acknowledge that, once streaming has begun, you lose the right to withdraw and receive a refund to the extent permitted by that law.

3.8 Price and plan changes. We may change plan prices or features. For an existing membership, a price increase takes effect no earlier than the first renewal that occurs at least 30 days after we notify you by email to your account address (or such longer notice as your local law requires). If you do not accept the new price, cancel before it takes effect; continuing to use the Service after the effective date constitutes acceptance.

3.9 Promotional and gift memberships. Promotional codes, partner offers, hidden plans and gift memberships are subject to the specific terms disclosed with the offer, may not be combined, transferred or redeemed for cash, and may be withdrawn at any time. Gift memberships are non-refundable once redeemed.

3.10 Taxes. Prices may exclude applicable sales, use, VAT, GST or similar taxes, which will be added where we are required to collect them.

3.11 Third-party billing. If you subscribe through Apple, Google, or another third-party platform, that platform is the merchant of record and its billing, cancellation and refund terms govern those transactions.

4. Your Licence to Use the Service

4.1 Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable licence to stream content and use the Service for your personal, non-commercial entertainment use within your household, on the number of simultaneous devices permitted by your plan.

4.2 You may not, and may not allow others to:

(a) download, record, capture, copy, screen-record, archive, rip, redistribute, publicly perform or display, broadcast, sell, rent, sublicense or otherwise exploit any content or part of the Service except as expressly enabled by us;
(b) circumvent, disable or interfere with DRM, encryption, geographic restrictions, concurrent-stream limits, advertising or any other technological protection or access control, including by VPN, proxy or location-spoofing for the purpose of evading restrictions;
(c) share your credentials or provide access to persons outside your household, or resell, transfer or commercially exploit accounts, trials or promotional codes;
(d) scrape, crawl, mine, index, or extract data, metadata, captions or thumbnails from the Service by automated means, or use any content or data from the Service to train or evaluate a machine-learning or artificial-intelligence model;
(e) reverse engineer, decompile or attempt to derive source code of any part of the Service or its apps except to the extent permitted by non-waivable law;
(f) use the Service in a public, commercial or communal setting (bars, venues, classrooms, churches, waiting rooms) without a separate written licence from us;
(g) frame, embed, mirror or hotlink any part of the Service, or use our trademarks, without written permission;
(h) introduce malware, probe or test the vulnerability of our systems, or impose an unreasonable load on our infrastructure; or
(i) use the Service for any unlawful purpose or in violation of these Terms.

4.3 Content availability. The titles, series, live events and features available on the Service change over time and may vary by country, device and plan because of licensing, rights windows, local law and technical reasons. We do not guarantee that any particular title will remain available, that content will be available in your country, or that the Service will be uninterrupted or error-free. Video quality depends on your device, plan, connection and location.

4.4 Apps and updates. Our applications are licensed, not sold. App updates may be required to continue using the Service and may change or remove features. App-store terms (including Apple's Licensed Application End User Licence Agreement) apply in addition to these Terms; where they conflict for an app-store transaction, the app-store terms control.

5. Intellectual Property

5.1 The Service and all content on it — including video programmes, live streams, audio, artwork, thumbnails, captions, metadata, text, software, user interfaces, trademarks (including SPARK, SPARK TV and the Spark logo) and the compilation and arrangement of all of these — are owned by Spark or its licensors and protected by copyright, trademark and other laws of the United States and other countries. Nothing in these Terms transfers any ownership to you. All rights not expressly granted are reserved.

5.2 Feedback. If you send us ideas, suggestions, content recommendations or feedback (including via our "Suggest Content" page), you grant us a perpetual, irrevocable, worldwide, royalty-free right to use them for any purpose without compensation or attribution, and you agree that we may already have or later develop similar ideas independently.

6. User Content and Community Conduct

6.1 User Content. The Service may include interactive surfaces such as Watch Party chat and reactions, casting and talent submissions, content suggestions, community pages and (where enabled) comments. Anything you post, upload or submit there is "User Content".

6.2 Licence to Spark. You retain ownership of your User Content. You grant Spark a worldwide, non-exclusive, royalty-free, sublicensable and transferable licence to host, store, reproduce, modify (for formatting and moderation), display, perform, distribute and otherwise use your User Content in connection with operating, moderating, promoting and improving the Service, for as long as your User Content remains on the Service and for a reasonable period after removal for backup and legal purposes. Casting, audition and talent submissions are additionally governed by the release presented at the point of submission.

6.3 Your responsibilities. You represent that you own or have all rights necessary to your User Content, that it does not infringe or violate anyone's rights or any law, and that it is not confidential. You are solely responsible for your User Content.

6.4 Conduct. You may not post or transmit User Content that: is unlawful, defamatory, harassing, threatening, hateful or discriminatory; is sexually explicit or exploits minors; contains personal information of others without consent ("doxxing"); infringes intellectual property; contains spam, solicitation, malware or links to them; impersonates any person; or, in Watch Party or live chat, disrupts the experience of others. Health, spiritual and wellness topics may be discussed, but you may not present User Content as professional medical, legal or financial advice.

6.5 Moderation. We may (but have no obligation to) monitor, moderate, remove, or refuse any User Content, and may suspend or terminate accounts that violate this Section, at our sole discretion and without notice. We may preserve and disclose User Content where required by law or to protect Spark, our users or the public.

6.6 No endorsement. User Content and the views expressed by hosts, guests and contributors are their own and do not represent Spark.

7. Copyright Complaints (DMCA)

7.1 We respect intellectual property and respond to notices that comply with the U.S. Digital Millennium Copyright Act, 17 U.S.C. §512. If you believe content on the Service infringes your copyright, send a written notice to our Designated Copyright Agent containing: (a) your physical or electronic signature; (b) identification of the copyrighted work claimed to be infringed; (c) identification and location (URL) of the allegedly infringing material; (d) your contact information; (e) a statement that you have a good-faith belief the use is not authorised by the owner, its agent or the law; and (f) a statement, under penalty of perjury, that the notice is accurate and that you are the owner or authorised to act for the owner.

Designated Copyright Agent: Spark TV LLC, Attn: Copyright Agent, 113 N San Vicente Blvd, Beverly Hills, CA 90211, USA · copyright@sparktv.ai

7.2 Counter-notices may be submitted to the same agent and must comply with 17 U.S.C. §512(g)(3). Repeat infringers will have their accounts terminated in appropriate circumstances. Knowingly submitting a false notice or counter-notice may expose you to liability under 17 U.S.C. §512(f).

8. Advertising, Third-Party Services and Links

8.1 Ad-supported plans include advertising served by us and by third-party advertising partners. Advertisements are not endorsements by Spark. The Service may contain links to, or integrations with, third-party websites, payment processors, identity providers, app stores, social networks and affiliate partners. We do not control and are not responsible for third-party services, their content, terms or privacy practices.

9. Health, Spiritual and Informational Content Disclaimer

Content on the Service — including programmes about health, nutrition, healing, psychology, consciousness, spirituality, alternative practices, the paranormal and personal transformation — is provided for entertainment and general information only. It is not medical, psychological, legal, financial or other professional advice, has not been evaluated by any regulatory authority, and is not a substitute for consultation with a qualified professional. Views expressed by hosts and guests are their own. Never disregard or delay professional advice because of something you watched on the Service. If you are in crisis, contact local emergency services.

10. Disclaimer of Warranties

TO THE FULLEST EXTENT PERMITTED BY LAW, THE SERVICE AND ALL CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS, IMPLIED OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AND UNINTERRUPTED OR ERROR-FREE OPERATION. SPARK DOES NOT WARRANT THAT ANY CONTENT WILL BE AVAILABLE AT ANY TIME OR IN ANY LOCATION, OR THAT THE SERVICE IS COMPATIBLE WITH YOUR DEVICE OR CONNECTION. Some jurisdictions do not allow the exclusion of implied warranties, so some of the above may not apply to you; in that case any implied warranty is limited to the minimum scope and duration permitted by law.

11. Limitation of Liability

11.1 TO THE FULLEST EXTENT PERMITTED BY LAW, SPARK AND ITS AFFILIATES, LICENSORS, CONTENT PARTNERS, SERVICE PROVIDERS, OFFICERS, MEMBERS, EMPLOYEES AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL OR USE, ARISING OUT OF OR RELATED TO THE SERVICE OR THESE TERMS, HOWEVER CAUSED AND UNDER ANY THEORY OF LIABILITY, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

11.2 TO THE FULLEST EXTENT PERMITTED BY LAW, SPARK'S TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID TO SPARK FOR THE SERVICE IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS (US$100).

11.3 Non-waivable rights. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, for gross negligence or wilful misconduct where such limitation is prohibited, or any statutory consumer rights that cannot be waived in your jurisdiction (including under California law, EU and UK consumer law, and the Australian Consumer Law). The limitations in this Section apply only to the extent permitted by the law of your place of residence.

12. Indemnification

To the extent permitted by law, you agree to defend, indemnify and hold harmless Spark and its affiliates, licensors, officers, members, employees and agents from and against any claims, liabilities, damages, losses and expenses (including reasonable attorneys' fees) arising out of or related to (a) your User Content, (b) your violation of these Terms or of any law or third-party right, or (c) your unauthorised use of the Service or any content. This Section does not apply to consumers in jurisdictions where such indemnities are unenforceable against consumers.

13. Suspension and Termination

13.1 By you. You may close your account at any time via My Account or by emailing support@sparktv.ai. Closing your account does not entitle you to a refund except as stated in Section 3.7.

13.2 By us. We may suspend, restrict or terminate your access to all or part of the Service, immediately and without liability, if we reasonably believe you have breached these Terms, if required by law, if your payment fails, if your conduct risks harm to Spark, other users or third parties, or if we discontinue the Service or a feature (in which case we will refund any prepaid fees for the discontinued period where we terminate for convenience). Where practicable and lawful we will give notice.

13.3 Survival. Sections 3.5–3.7, 4.2, 5, 6.2, 6.3, 9–12, 13.3, 15, 16 and 17 survive termination.

14. Changes to the Service and these Terms

14.1 We continually change and improve the Service and may add, modify or remove features, content, plans or platforms at any time.

14.2 We may revise these Terms. If a change is material, we will give at least 30 days' notice by email to your account address and/or a prominent notice on the Service before it takes effect (changes required by law or that only add new features may take effect sooner). The "Effective date" above shows when the current Terms took effect. Your continued use of the Service after the effective date constitutes acceptance; if you do not agree, cancel your membership and stop using the Service before that date. Changes do not apply retroactively to disputes that arose before the change.

15. Dispute Resolution — Binding Arbitration and Class Action Waiver

This Section applies to you if you reside in the United States. If you reside outside the United States, see Section 16.

15.1 Informal resolution first. Before starting arbitration or any court proceeding, you and Spark agree to try to resolve the dispute informally. Send a written notice describing the dispute and the relief sought to legal@sparktv.ai or to the address in Section 18 ("Notice of Dispute"). We will send our notice to your account email. If the dispute is not resolved within 60 days after the notice is received, either party may proceed under this Section. The parties agree to participate in at least one good-faith telephone or video conference during this period; the statute of limitations is tolled while it runs.

15.2 Agreement to arbitrate. Except as provided in Section 15.5, any dispute, claim or controversy arising out of or relating to these Terms, the Service, your account, our advertising or any content, whether based in contract, tort, statute, fraud or any other legal theory, and whether arising before or after these Terms, will be resolved exclusively by final and binding individual arbitration rather than in court. This agreement is governed by the Federal Arbitration Act (9 U.S.C. §1 et seq.). The arbitrator, and not any court, has exclusive authority to resolve disputes about the interpretation, applicability, enforceability or formation of this arbitration agreement, except that a court will decide the enforceability of the class action waiver in Section 15.4.

15.3 Procedure. The arbitration will be administered by JAMS under its Streamlined Arbitration Rules and Procedures (or Comprehensive Rules where the amount in controversy exceeds the Streamlined threshold) and, where applicable, its Consumer Arbitration Minimum Standards, as in effect when the claim is filed (available at jamsadr.com). If JAMS is unavailable, the parties will agree on an alternative administrator or a court will appoint one. The arbitration will be conducted by a single arbitrator, in English, and — at your election — by video conference, by written submissions, or in person in the county where you reside. Fees: for claims brought by consumers, Spark will pay all JAMS filing, administrative and arbitrator fees beyond the first US$250 of the filing fee, unless the arbitrator finds the claim frivolous or brought for an improper purpose. Each party bears its own attorneys' fees, except where the arbitrator awards fees under applicable law. The arbitrator may award any individual relief a court could award, and judgment on the award may be entered in any court of competent jurisdiction.

15.4 Class action and jury waiver. YOU AND SPARK AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, CONSOLIDATED OR REPRESENTATIVE PROCEEDING. The arbitrator may not consolidate more than one person's claims or preside over any form of representative proceeding, and may award relief only in favour of the individual party seeking it and only to the extent necessary to provide relief warranted by that party's individual claim (except that a public-injunctive-relief claim under California law that cannot be waived will, if asserted, be stayed pending arbitration of all other claims and then decided by a court). You and Spark each waive the right to a trial by jury. If the class action waiver is found unenforceable as to a particular claim or request for relief, that claim or request (and only that) will be severed and litigated in court under Section 15.6, with all remaining claims arbitrated.

15.5 Exceptions. Either party may (a) bring an individual claim in small claims court in the county of your residence or Los Angeles County, California, if it qualifies; (b) seek injunctive or other equitable relief in court to protect intellectual property rights or prevent unauthorised access to the Service; or (c) bring a claim that applicable law prohibits from being arbitrated.

15.6 Mass arbitration. If 25 or more similar demands for arbitration are filed against Spark by or with the assistance of the same or coordinated counsel within 90 days, the parties agree to (i) the JAMS Mass Arbitration Procedures and Guidelines then in effect, and (ii) a bellwether process in which 10 cases selected in equal numbers by each side proceed first while the remainder are stayed, followed by a 60-day mandatory global mediation before further cases proceed. Filing fees for stayed cases are deferred until those cases proceed. Statutes of limitations are tolled for stayed cases.

15.7 30-day right to opt out. You may reject this arbitration agreement and class action waiver by emailing legal@sparktv.ai (or writing to the address in Section 18) within 30 days after you first accept these Terms or create an account, whichever is later, stating your name, account email and that you opt out of arbitration. Opting out does not affect any other part of these Terms. If you opt out, or where arbitration is unavailable, disputes will be resolved in the state or federal courts located in Los Angeles County, California, and you consent to personal jurisdiction and venue there.

15.8 Changes to this Section. If we change this Section after you accept these Terms, you may reject the change by notifying legal@sparktv.ai within 30 days; the prior version will then continue to govern disputes between you and Spark.

16. Governing Law; International Users

16.1 Governing law. These Terms and any dispute arising out of them or the Service are governed by the laws of the State of California and applicable U.S. federal law, without regard to conflict-of-law rules, and the United Nations Convention on Contracts for the International Sale of Goods does not apply.

16.2 Worldwide availability. The Service is operated from the United States and made available to users worldwide. Content availability, pricing, plans, features and payment methods may vary by country. We make no representation that the Service or any content is appropriate or lawful in any particular location; you are responsible for compliance with local law where you access it.

16.3 Mandatory local law. If you are a consumer residing outside the United States, you benefit from any mandatory provisions of the consumer-protection law of your country of residence that cannot be excluded by contract (for example, the withdrawal, guarantee and remedy rights of EU, UK or Australian consumer law). Nothing in these Terms limits those rights. Where mandatory local law prohibits binding pre-dispute arbitration or a class waiver, Section 15 does not apply to you, and disputes may be brought either in the courts of Los Angeles County, California or, where mandatory law so provides, the courts of your country of residence. EU consumers may also use the European Commission's Online Dispute Resolution platform.

16.4 Export and sanctions. You may not use the Service if you are located in a country or on a list subject to U.S. embargo or sanctions, and you agree to comply with applicable export laws.

17. General

17.1 Entire agreement. These Terms, together with the Privacy Policy, Cookie Policy and any plan-specific or offer-specific terms presented to you, are the entire agreement between you and Spark about the Service and supersede all prior terms.
17.2 Severability. If any provision is held unenforceable, it will be enforced to the maximum extent permitted and the remainder will remain in effect (subject to Section 15.4).
17.3 Waiver. Our failure to enforce any provision is not a waiver.
17.4 Assignment. You may not assign these Terms. We may assign them to an affiliate or a successor in connection with a merger, acquisition or sale of assets, on notice to you.
17.5 Force majeure. We are not liable for delay or failure caused by events beyond our reasonable control, including failures of third-party networks, CDNs, payment processors, app stores or hosting providers.
17.6 Electronic communications. You consent to receive notices, disclosures and communications from us electronically, at your account email or through the Service, and agree they satisfy any legal requirement that a communication be in writing.
17.7 Language. These Terms are written in English; any translation is for convenience and the English version controls.
17.8 Apple-specific terms. For iOS/tvOS apps: these Terms are between you and Spark, not Apple; Apple has no obligation to furnish maintenance or support, is not responsible for any product warranty, product claim or intellectual-property claim, and is a third-party beneficiary of these Terms with the right to enforce them against you.
